Dedicated statutory structure
RCW 26.26A.700 through 26.26A.785 address surrogacy agreements. The chapter separately covers eligibility to enter an agreement, process and content requirements, venue and jurisdiction, termination, and parentage.
Do not reduce the law to a label
Washington has a detailed statutory framework, but that does not mean every family should assume the same filing path or outcome. Marital status, residence, the parties' connections to Washington, the agreement and other facts can affect legal planning.
Agreement process matters
The statute includes formal requirements for surrogacy agreements. Parties should use Washington reproductive counsel and coordinate the legal process with the fertility clinic before treatment rather than relying on a generic agreement template.
Termination and parentage are addressed separately
The RCW contains specific sections dealing with termination of gestational-surrogacy agreements and with parentage and orders of parentage. Counsel should identify which provisions apply and when filings should occur in the particular case.
Marital status
Washington's parentage chapter expressly provides that parentage rules are not to discriminate based on a parent's marital status. That is different from claiming that every parentage procedure is identical for every family; the procedural plan should still be confirmed with counsel.
No ranking or universal PBO promise
We do not rank Washington as “best,” describe a pre-birth order as automatic, or state that every family type follows the same process. The useful fact is that Washington has current statutory provisions specifically addressing surrogacy and parentage.
