Parentage procedure
The appropriate parentage filing, timing, jurisdiction, and documentation should be confirmed for the specific parties and expected birth location with South Dakota reproductive counsel. This guide does not assume a pre-birth order is available or unavailable in every case.
Agreement review
The agreement should address compensation and expenses, insurance, medical decision-making, legal costs, dispute procedures, and parentage planning. Separate counsel for the surrogate and intended parents helps ensure each party's interests are reviewed independently.
