Current law versus proposed changes
New Mexico's parentage framework has included gestational-agreement concepts. More recent bills have proposed detailed eligibility, agreement, medical-autonomy, compensation, and parentage provisions. A bill should not be described as current law unless it has been enacted and taken effect.
Parentage procedure
The availability, timing, and form of a parentage order should be confirmed for the actual arrangement with New Mexico reproductive counsel. This guide does not assume routine pre-birth orders or a guaranteed birth-record outcome for every family structure.
Agreement review
The agreement should address compensation and expenses, insurance, medical decision-making, legal costs, dispute procedures, and parentage planning. The surrogate remains the patient and retains authority over her own medical care.
Family structure
Intended-parent eligibility and parentage analysis should be based on the current statute and the facts of the case rather than a generalized LGBTQ+, marital-status, or family-type rating.
