Current law, not proposed legislation
Recent Kentucky bills have proposed more detailed surrogacy rules. Proposed legislation should not be presented as current law unless it has been enacted and taken effect. Intended parents should confirm which provisions are actually in force at the time of their agreement.
Parentage procedure
Kentucky does not offer a single statutory gestational-surrogacy pathway comparable to states with a comprehensive surrogacy act. The appropriate parentage filing, timing, jurisdiction, and birth-record procedure should be confirmed with Kentucky reproductive counsel for the specific case.
Agreement review
The agreement should address compensation and expenses, insurance, medical decision-making, legal costs, dispute procedures, and parentage planning. Do not assume that a pre-birth order or birth-certificate outcome is automatic because a written agreement exists.
