What Is Gestational Surrogacy?
In gestational surrogacy, an embryo created via in vitro fertilization (IVF) is transferred to the uterus of a surrogate — also called a gestational carrier. The embryo may be created using the intended mother's eggs and the intended father's sperm, or with donor eggs, donor sperm, or both. Critically, the surrogate has no genetic connection to the baby she carries. She is not the biological mother.
This is the defining difference from traditional surrogacy, in which the surrogate's own egg is used — making her the genetic mother. Traditional surrogacy is rarely practiced in US agency-supported journeys today due to the significant legal and emotional risks that come with that genetic connection.
Most US agency-supported surrogacy arrangements today are gestational, meaning the surrogate has no biological relationship to the child she carries.
Who Pursues Gestational Surrogacy?
Intended parents are a diverse group. The most common reasons people pursue gestational surrogacy include:
- Medical conditions affecting the uterus: Including uterine absence (MRKH syndrome), significant fibroids, Asherman's syndrome, prior hysterectomy, or a uterus that cannot safely support a pregnancy.
- Serious health conditions: Heart disease, kidney disease, lupus, cancer history, or other conditions where pregnancy would pose a significant health risk.
- Recurrent implantation failure: When embryo quality is good but implantation repeatedly fails despite multiple IVF cycles.
- Same-sex male couples: Two male partners need both an egg donor and a gestational surrogate to have a biological child.
- Single men: Single men pursue surrogacy similarly to same-sex male couples — requiring an egg donor and a surrogate.
- Transgender individuals: Trans women and non-binary individuals may pursue surrogacy as a path to parenthood depending on their medical history, fertility preservation, and family-building goals.
- Single women: Women who cannot safely carry a pregnancy may use their own eggs, fertilized with partner or donor sperm, and a surrogate.
What Is a Gestational Carrier Agreement (GCA)?
Before embryo transfer and related transfer-medication steps, intended parents and their surrogate generally must sign a Gestational Carrier Agreement — a detailed legal contract negotiated and reviewed by separate, independent attorneys for each party. This document covers surrogate compensation, expense reimbursements, medical decision-making authority, protocols for selective reduction or termination, and how parental rights will be legally established.
In agency-supported gestational surrogacy, fertility clinics generally require legal clearance and a fully executed GCA before embryo transfer. Specific timing can vary by state, clinic, and which screening or evaluation step is being performed.
Gestational vs. Traditional Surrogacy
Gestational surrogacy: Surrogate has no genetic connection to the baby. Embryo created via IVF with intended parents' or donor genetic material. This is the standard arrangement in US agency-supported surrogacy and usually offers cleaner legal protections for all parties.
Traditional surrogacy: Surrogate is also the egg donor and genetic mother. Creates significant legal complexity around parental rights. Most agencies, fertility clinics, and attorneys in the US no longer facilitate traditional surrogacy.
